Domain and SSL Certificate Terms - RaiaWeb

These terms form an integral part of RaiaWeb's Terms and Conditions of Service and apply to the registration, renewal, transfer and management of domain names, as well as to the supply of SSL certificates. Capitalised terms have the meaning defined in the Terms and Conditions.

Part I - Domains
1. Framework
1.1. RaiaWeb provides domain services through registrars and competent registration entities. Each domain is subject, in addition to these terms, to the rules of the respective entity: the .pt Registration Rules (DNS.pt) for .pt domains, and the policies of ICANN and of the applicable registry for international domains (gTLDs), including the transfer policy and the Expired Registration Recovery Policy (ERRP).
1.2. The Client accepts the rules referred to in the previous paragraph at the time of registration, renewal or transfer of each domain, and acknowledges that the allocation of the domain depends on acceptance by the competent registration entity.
2. Registration Data
2.1. The Client undertakes to provide and maintain accurate, complete and up-to-date registration data (registrant and contacts). Inaccurate data may lead to suspension or cancellation of the domain by the competent entities, with no right to a refund.
2.2. For international domains, the registrant's email may have to be verified under ICANN policies; failure to verify within the applicable period may result in suspension of the domain.
2.3. Registrant data are transmitted to the registrar and to the registration entities and may be published or made available through registration data lookup services (WHOIS/RDAP), under those entities' policies and data protection law. If the Client provides third-party data, it warrants that it is authorised to do so.
3. Registration, Renewal and Expiration
3.1. Registration takes effect after confirmation by the competent entity and successful payment. A domain's availability is only guaranteed upon confirmation of registration.
3.2. Renewal is automatic upon timely payment, under clause 7 of the Terms and Conditions. RaiaWeb sends expiration notices to the Client's email, including, for international domains, the notices required by ICANN (approximately one month and one week before expiration, and after it).
3.3. Domains not renewed by the expiration date are deactivated and may enter a quarantine/redemption period, during which recovery is subject to the additional fees imposed by the registration entities. After the applicable periods elapse without recovery, the domain is released and may be registered by third parties.
3.4. Completed registrations, renewals and transfers are final and non-refundable, under clauses 8.5 and 9.3 of the Terms and Conditions. Typing errors in the domain name made by the Client do not confer a right to a refund or exchange, without prejudice to RaiaWeb seeking, upon request, solutions with the registration entity where possible.
4. Transfers
4.1. The Client may transfer its domains to and from RaiaWeb, under the rules of the applicable registration entity, using the authorisation code (auth code/EPP) and unlocking the domain, where applicable.
4.2. For international domains, ICANN policies impose a 60-day lock period after initial registration or after a transfer, during which a further registrar transfer may not be possible.
4.3. A transfer does not change the expiration date to the Client's detriment, under the rules applicable to each extension.
5. Domain Disputes
5.1. Disputes concerning the ownership or registration of .pt domains may be submitted to ARBITRARE - Arbitration Centre for Industrial Property, Domain Names, Company Names and Denominations (https://www.arbitrare.pt), under the .pt Registration Rules.
5.2. Disputes concerning international domains (gTLDs) follow ICANN's UDRP - Uniform Domain-Name Dispute-Resolution Policy and the policies of the respective registry.
5.3. RaiaWeb acts as a technical intermediary and complies with the decisions of the registration entities and of the competent dispute-resolution bodies, and is not a party to disputes over domain ownership.
Part II - SSL Certificates
6. Supply and Types
6.1. SSL certificates are supplied through partner providers and certificate authorities ("CA"), in particular through the SSLs.com platform and the CAs it represents (including Sectigo). Each certificate is subject to the issuing CA's Subscriber Agreement and policies.
6.2. RaiaWeb offers domain-validated (DV), organisation-validated (OV) and extended-validation (EV) certificates, including Wildcard variants (DV and OV).
7. Validation and Issuance
7.1. DV: issuance depends on demonstrating control of the domain (DNS record, file on the server or validation email) and is generally quick and automated.
7.2. OV and EV: issuance depends on the CA's documentary validation of the organisation (legal existence, registration data, verifiable telephone contact, among others) and may take several business days. The Client undertakes to provide the requested documentation; the indicated timeframes are estimates and depend exclusively on the CA.
7.3. Refusal of issuance by the CA due to a fact attributable to the Client (incorrect data, impossibility of validation) does not confer a right to a refund, unless the CA's own policy is more favourable, in which case RaiaWeb will pass it on to the Client.
7.4. Issuance of the certificate constitutes full performance of the service, under clauses 8.5 and 9.3 of the Terms and Conditions.
8. Use, Reissuance and Revocation
8.1. Reissuance (for example, due to a server change) and revocation follow the issuing CA's policies. Revocation due to breach of the Subscriber Agreement or compromise of the private key does not confer a right to a refund.
8.2. The financial warranties associated with certificates are provided by the issuing CA, under the terms it defines, and not by RaiaWeb.
8.3. Safekeeping of the private key is the Client's responsibility, except where the certificate is installed and managed by RaiaWeb as part of a hosting service.
9. Data and International Transfers
The data necessary for issuance (domain, contacts and, for OV/EV certificates, organisation data) are transmitted to the provider SSLs.com (Namecheap, Inc., USA) and to the issuing CA. International transfers are carried out with the safeguards described in the Privacy Policy.
10. Final Provisions
In all matters not provided for in these terms, the Terms and Conditions of Service apply, including as regards the right of withdrawal (clause 8) and complaints and dispute resolution (clause 26).
